Booking Terms and Conditions
Booking Procedure
Once a booking request for Olive garden Villa (hereafter known as ‘the property’) has been received and agreed in principle, a booking form will be issued to the designated party leader (hereafter known as ‘the customer’), together with the booking terms and conditions. Upon receipt of the booking form, and the terms and conditions of the booking, ‘the customer’ who must be at least 18 years of age, must signed the booking form and return it to us (hereafter known as ‘the owners’) by a date that will be specified. All future correspondence will be with ‘the customer’. Confirmation of your booking will be sent in writing on receipt of the signed booking form and deposit and/or total rental payment. The issue of this confirmation constitutes a contract between ‘the owners’ and ‘the customer’, which is governed by English Law.
Rental Payment
Deposit (25%)
A non-refundable deposit of 25% of the total rental payment, for the specified rental period, is required, with the signed booking form, to confirm a booking request.
Paying the Balance (75%)
The balance of the total rental payment (75%) is payable not less than 8 weeks (56 days) prior to departure and the total rental payment is required if the booking is made within 8 weeks of departure. In the event of full payment not being made by the due time ‘the owners’ reserve the right to cancel the booking. Any deposits will be forfeited and ‘the customer’ will be required to pay cancellation charges in accordance with cancellations made by ‘the customer’.
Refundable Bond (£200)
A refundable ‘breakages/damage’ bond of £200 per booking, as a separate cheque, is payable with the balance of your payment, 8 weeks prior to departure. It is returned to you one week after the end of your holiday unless any costs have been incurred, including but not limited to accidental damage to the property and any contents, excess cleaning and loss/non-return of keys. In the event of cancellation it is always refunded.
Rental Payment: Inclusions and Exclusions
The total payment is for rental of ‘the property’ on self-catering basis and includes: the facilities available at ‘the property’, water, gas, and electricity The total payment does not include: flights to North (Northern) Cyprus, transfers to and from Ercan airport, car rental and travel insurance.
Travel Insurance
It is considered essential for ‘the customer’ to hold suitable “comprehensive” travel insurance to include; cancellation cover, personal belongings, public liability, etc as these are NOT covered by ‘the owner’s’ insurance. It is also advisable for this insurance to be in place as soon as ‘the customer’ receives confirmation of the booking from the owner. If reasons for a cancellation made by ‘the customer’ fall within the terms of ‘the customer’s’ holiday insurance policy, ‘the customer’ should make a claim direct to the insurance company.
Accommodation
Access to ‘the property’ is available from 14:00 on the agreed arrival date and must be vacated by 10:00 on the agreed departure date. This allows cleaning and preparation for yourselves and the next guests to take place. ‘The property’ is reserved exclusively for people named on ‘the customers’ booking form and no other persons are permitted to stay there unless this has been agreed in writing with ‘the owner’ prior to the rental period. ‘The property’ accommodates a maximum of 6 people sleeping in 3 bedrooms.
Changes of rental booking period made by ‘the customer’
‘The owners’ will endeavour to facilitate any changes in rental period after the booking has been confirmed. The alteration will be effective as soon as ‘the owners’ send written confirmation to ‘the customer’ of the change. No changes can be made within eight weeks of departure.
Cancellations made by ‘the customer’
Cancellations must be by letter and be signed by ‘the customer’. Cancellations will become effective from the date the cancellation letter is received by ‘the owners’. All cancellations are subject to a charge, as a percentage of the total rental payment for ‘the property’; payable by ‘the customer’ as detailed below:

Complaints
If there are any problems with ‘the property’ during the rental period, ‘the customer’ must inform the owners Steve and Beverley Jones who will try and resolve the matter to the customer’s satisfaction immediately. If the matter is not resolved, ‘the customer’ must follow up the complaint by writing to ‘the owners’ within 14 days of the end of the rental period. If the problem has not been reported as detailed in this clause then ‘the owners’ cannot accept responsibility for any complaints. Under no circumstances shall ‘the owner’s’ liability to ‘the customer’ exceed the total amount paid to ‘the owners’ by ‘the customer’ for the rental booking period.
Liabilities
‘The owners’ do not accept any responsibility or liability for acts of omission of third parties, which may prevent or disrupt ‘the customer’s’ booking. The booking contract exists between ‘the owners’ and ‘the customer’ and is limited to the rental of ‘the property’ and associated services only. The information and descriptions supplied are believed to be accurate and offered in good faith. Certain features or facilities may not be available from time to time, due to circumstances beyond our control, for which ‘the owners’ accept no liability. In addition, no liability can be accepted by ‘the owners’ for any injury, loss or damage to ‘the customer’, any member of ‘the customer’s’ party or any visitor to the rental property, arising out of or in connection with the use of ‘the property’, or ‘the property’s’ pool. ‘The customer’ must ensure that all children are supervised at all times.
Changes/cancellations made by ‘the owner’
If circumstances beyond ‘the owner’s’ control should make ‘the property’ unavailable, then ‘the customer’ will be advised as soon as possible. Alternative accommodation of at least comparable standard will be offered if available, or a full refund of monies paid, unless the change/cancellation arises from reasons of ‘Force Majeure’ (see below).
Public Services
‘The owners’ cannot accept any responsibility for the breakdown of public services including water, electricity or any other facility which is beyond our control. In the event of the breakdown of any equipment belonging to Olive Garden Villa, please notify the owners immediately.
Force Majeure
No liability can be accepted by ‘the owners’ where the contract is affected by ‘force majeure’. In the context of these terms and conditions, ‘force majeure’ is any event that ‘the owners’ could not, even with due care, foresee or avoid. These events include but are not limited to war, threat of war, riot, civil commotion or strife, hostilities, industrial dispute, natural disaster, fire, acts of God, terrorist activity, nuclear disaster, adverse weather, government action, technical problems with transportation or other events outside ‘the owner’s’ control.

List of Facilities
Olive Garden Villa will be clean and ready for you on your arrival. Bed linen and house towels are provided but please provide your own beach and poolside towels.
A welcome pack of groceries and drinks is provided for your convenience on arrival.
A folder containing useful local information and operating instructions for the appliances and equipment, is available.
For your safety there is an ‘emergencies drawer’ in the kitchen. The drawer contains: spare light bulbs, a torch, matches and candles. Please inform Steve and Bev if you have used anything from the drawer, so we can replace the items for the safety of future customers.
There are individual air-conditioning units in all three bedrooms, each with a remote control. Please keep exterior doors and windows closed whilst using the air-conditioning as it functions more efficiently and electricity is expensive in North Cyprus.
The kitchen has a cooker and hob (bottle gas), microwave, large fridge/ freezer, kettle, toaster, sandwich toaster, all necessary crockery, cutlery, glassware and kitchen utensils. There is also a washing machine and a steam iron, ironing board and clothes hanger. The living room is equipped with a television, a DVD/video player, a portable CD player/radio and a selection of books.
Please remove sunscreen prior to swimming or entering the villa.
Unfortunately, our policy is that if the owners find any unreported breakages or damage after departure we must assume ‘the customer’ was responsible. ‘The owners’ reserve the right to subtract repair/replacement costs from ‘the customers’ refundable bond. Therefore, in order to avoid embarrassing correspondence later, please report to ‘the owners’ at the earliest opportunity, any breakages or damage. If a repair is required or a serious breakage occurs, we will obtain an estimate and we will invoice you later.
